1. Introduction
Welcome to the TruKKer LoadBoard Application (“LoadBoard”, “Platform”, “Application”),
operated by TruKKer Technologies DMCC and its affiliates (“TruKKer”, “we”, “us”, “our”).
These Terms and Conditions (“Terms”) govern your access to and use of the TruKKer
LoadBoard Application and associated services. By accessing or using the Platform, you agree
to be bound by these Terms, our Privacy Policy, and any additional policies or guidelines made
available on the Platform.
If you do not agree with any part of these Terms, you must not use the LoadBoard.
2. Definitions
● “User” means any individual or entity accessing the LoadBoard, including shippers,
carriers, drivers, vendors, and logistics coordinators.
● “Shipper” refers to individuals or companies posting loads or freight to be transported.
● “Carrier” refers to truckers, drivers, or transport companies offering logistics and
transportation services.
● “Services” refer to load posting, bidding, matching, tracking, and any other feature
provided through the LoadBoard.
● “Agreement” refers to this legally binding contract, including the Privacy Policy and all
referenced documents.
3. Eligibility
To use the LoadBoard, you must:
● Be at least 18 years of age (or the legal age of majority in your jurisdiction).
● Have the legal authority to enter into binding agreements on behalf of a business entity
(if applicable).
● Register with complete and accurate information.
● Maintain compliance with applicable transportation, logistics, and safety laws.
4. Account Registration & Security
4.1 Registration
You must register an account to access LoadBoard features. You agree to:
● Provide accurate, current, and complete information.
● Maintain the security of your account credentials.
● Notify TruKKer of any unauthorized access or breach.
4.2 Account Responsibility
You are solely responsible for:
● All activities under your account, including content posted or actions taken.
● Ensuring your information remains updated and accurate.
● Keeping login credentials confidential.
TruKKer reserves the right to suspend or terminate any account at our discretion for any breach
of these Terms.
5. Use of the Platform
5.1 Permitted Uses
The LoadBoard may only be used for lawful freight matching and logistics coordination,
including:
● Posting and browsing available loads.
● Submitting and reviewing freight bids.
● Communicating with carriers/shippers through built-in messaging.
● Executing contracts and tracking deliveries.
5.2 Prohibited Conduct
You agree not to:
● Post false, misleading, or unauthorized information.
● Use bots, scrapers, or automated systems without express permission.
● Engage in fraud, abuse, harassment, or unlawful behavior.
● Impersonate another user or business entity.
● Attempt to disrupt or impair platform operations.
6. Load & Contract Management
6.1 Posting Loads
Shippers must ensure that:
● All load details are accurate (weight, size, type, destination).
● Pickup and delivery times are feasible.
● Posted loads do not contain prohibited or illegal items.
6.2 Carrier Commitments
By accepting a load, carriers agree to:
● Fulfill transportation services as described.
● Maintain required licenses, permits, and insurance coverage.
● Comply with applicable safety, road, and labor regulations.
6.3 Service-Level Agreements (SLAs)
Any agreement entered via the LoadBoard (including rates, timelines, penalties) shall be binding
on both parties. TruKKer is not a party to these agreements unless explicitly stated.
7. Payments, Fees & Charges
7.1 Pricing
Service charges, platform usage fees, or transaction fees (if any) will be disclosed prior to load
acceptance or contract finalization.
7.2 Payment Processing
Payments may be facilitated via:
● Bank transfers
● Digital wallets
● PCI DSS-compliant payment gateways
7.3 Taxes
All Users are responsible for compliance with applicable VAT, sales tax, or other local tax
regulations. TruKKer may withhold or report certain payments as required by law.
8. Intellectual Property
8.1 Ownership
All content, software, trademarks, and branding on the LoadBoard belong to TruKKer or its
licensors.
8.2 User License
You are granted a limited, revocable, non-transferable license to use the LoadBoard for its
intended business purpose.
You may not:
● Modify, copy, reproduce, or distribute platform content without permission.
● Reverse-engineer or decompile any software used in the platform.
9. Privacy & Data Use
9.1 Data Collection
Use of the LoadBoard is subject to our Privacy Policy, which explains how we collect, use, and
share your data, including:
● Personal information
● Financial and transactional records
● Location and behavioral data
9.2 Consent
By using the LoadBoard, you consent to:
● Data collection and processing as per the Privacy Policy.
● Cross-border data transfers if required for service fulfillment.
● Communication from TruKKer regarding platform usage, updates, and legal notices.
10. Suspension & Termination
TruKKer may suspend, restrict, or terminate your account:
● For any violation of these Terms
● If required by law or regulatory obligation
● Due to fraudulent, unsafe, or harmful activity
You may terminate your account at any time by emailing contact@trukker.com. Data retention
will be governed by our Privacy Policy and legal obligations.
11. Limitation of Liability
To the extent permitted by law:
● TruKKer is not liable for direct or indirect damages resulting from load cancellations,
payment disputes, delays, or user misconduct.
● TruKKer does not guarantee platform uptime, data availability, or business outcomes.
● All freight agreements are between Users unless otherwise specified.
12. Indemnification
You agree to indemnify and hold TruKKer harmless against any claims, losses, or liabilities
arising from:
● Your use or misuse of the LoadBoard
● Breach of these Terms
● Disputes with other Users
13. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the United Arab Emirates. Any dispute shall
be subject to the exclusive jurisdiction of the courts in Dubai.
14. Modifications to the Terms
TruKKer reserves the right to update these Terms at any time. Updated Terms will be posted on
the LoadBoard and communicated via email or in-app notification.
Continued use of the Platform after such updates constitutes your acceptance.
